The client had paid a considerable sum in advance, but the housing did not meet the agreed standards.

Context of the case

Our client is a wealthy foreign businessman who had rented a luxury villa in Ibiza for a holiday of almost two weeks.

The rental price was 85,000 euros, a figure that reflected the high expectations placed on the property.

However, when he arrived at the property, he found a situation that was far from what he had expected and what he had paid for.

The house, located in Sant Josep de sa Talaia, was in a deplorable state. Not only was it dirty, with the remains of a party organised by previous tenants, but it also had multiple damages.

Door locks were broken, appliances did not work, and security railings were loose, among other problems.

Faced with this situation, our client decided not to spend a single night in the villa and immediately moved to a hotel from where he could rent another property that would meet his expectations.

The court of first instance agreed with us and ruled in our favour, condemning the property manager to compensate our client with a total of 117,360 euros, which included the 85,000 euros paid in advance and the additional expenses incurred by our client.

In the Provincial Court, we reiterated that the manager did not meet the minimum expectations of the contract, and that the client had acted reasonably in abandoning the villa in the deplorable state it was in.

In addition, we emphasised that the time-limited nature of the client’s holiday made it unfeasible to accept any delay in delivering the property in optimum condition.

Confirmation of the Judgment in Favour of the Client

Finally, the Provincial Court upheld the judgement in favour of our client.

The court confirmed that the real estate manager should compensate the client with a total of 117,360 euros, considering that the damages and the poor condition of the property constituted a serious breach of the agreement, which justified the return of the money and the payment of the additional expenses incurred by our client.

This case is a clear example of the importance of enforcing agreements.
